Municipal Consents

Municipal consents are administered by the Corridor Approvals and Records section of York Region's Roads Transportation Branch. Our role, as managers of the Regional rights of way, is to review and provide consent to place utilities, sidewalks and any other street furniture in the Regional rights of way.

What is a "Municipal Consent"?

 

A "Municipal Consent" is an approval of a comprehensive Road Occupancy Permit submission. This involves a formal drawing submission for the placement of apparatus within York Region's road allowance which has been approved by York Region's Utility Plans Co-ordinator.

When work requires an excavation within the regional Road right of way, or the work is for the placement of additional utility infrastructure, approval for this work is granted by a Municipal Consent. With the exception of Emergency Work, no excavation shall commence on a Regional Right of Way before the issuance of a Municipal Consent by the Region.

 

 

What is an "MAA", "Franchise Agreement" or "Occupancy Agreement"?

 

An "MAA" (Municipal Access Agreement), "Franchise Agreement" or "Occupancy Agreement" in an agreement between the Region of York and a Utility which has been approved by Regional Council that contains one or more provisions for the granting of consent to a person to do Work in the Public Road allowance.

 

How do I apply for an MC?

 

Municipal Consents and Road Occupancy Permits are only issued to utility companies, commissions, agencies and municipal departments and private applicants which have the authority to construct, operate and maintain their infrastructure on the public road allowance, as established through legislation or terms of a Municipal Access Agreement Franchise Agreement or Occupancy Agreement.

All work within the Public Road Allowance, with the exception of work specified in, requires Municipal Consent from the Utilities/Plans Co-ordinator and a Road Use Permit from the Permits Officer. The applicant understands and agrees that in making an application for a Right-of-Way municipal consent and/or permit, the applicant agrees to abide by the terms and conditions of the consent and or/permit.

 

 

The application form for Municipal Consent is included at the end of this section. The application form shall be fully completed prior to submitting to the Utilities/Plans Coordinator for review and approval. Incomplete forms will be returned to the applicant. The date of application will be the date on which the Utilities/Plans Coordinator receives the completed form.

One application form shall be completed for each street location where the proposed work is to be carried out. If, in the opinion of the Utilities/Plans Coordinator, additional applications are required due to the length of the work to be carried out, the applicant shall provide the requested applications.

Applications shall be submitted to York Region at least 30 business days prior to the planned date of commencing the work.
