COUNCIL OF THE January 21, 2010 Regional Council met at 9:30 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Fisch presiding. The following were present at this Meeting: Mayor: Black, Emmerson, Grossi, Jackson, Morris, Scarpitti, Van Bynen and Young Regional Councillor: Ferri, Frustaglio, Heath, Hogg, Jones, Landon, Rosati, Spatafora, Taylor, Virgilio and Wheeler Staff: Davidson, Hulton, Kurji, Llewellyn-Thomas, Macgregor, Mahoney, Norton, Russell and Tuckey 1 MINUTES It was moved by Regional Councillor Taylor, seconded by Mayor Young that Council confirm the Minutes of the Council meeting held on December 16, 2009 in the form supplied to the Members. Carried 2 COMMITTEE REPORTS It was moved by Mayor Black, seconded by Regional Councillor Ferri that Council resolve itself into Committee of the Whole to consider the following reports: Report No. 1 of the Community and Health Services Committee Report No. 1 of the Environmental Services Committee Report No. 1 of the Finance and Administration Committee Report No. 1 of the Transportation Services Committee Report No. 1 of the Commissioner of Finance Report No. 1 of the Commissioner of Corporate Services Report No. 1 of the Chief Administrative Officer Carried Regional Chair Fisch chaired the Committee of the Whole. Report 1 of the Chief Administrative Officer It was moved by Mayor Emmerson, seconded by Regional Councillor Frustaglio that Council adopt the recommendations of the Committee of the Whole, with Clause 3 of Community and Health Services Committee Report No. 1 to be voted on separately as its adoption was the subject of a request for a recorded vote. Carried 3 Specific Housing Mandates for Ja'Fari Islamic Housing Corporation and OHR Somayach Residential Centre Inc. (Clause 3 of Community and Health Services Committee Report No.1) A recorded vote on the adoption of the recommendations in Clause 3 of Community and Health Services Committee Report No. 1 was as follows: FOR: Black, Emmerson, Ferri, Frustaglio, Heath, Jackson, Jones, Landon, Morris, Rosati, Scarpitti, Spatafora, Van Bynen, Virgilio, Wheeler and Young (16) AGAINST: Grossi, Hogg, Taylor (3) Carried 4 BY-LAWS It was moved by Regional Councillor Frustaglio, seconded by Mayor Grossi that Council introduce and approve certain Bills in the form as noted on the Revised Agenda and enact them as By-laws. [The following links open .pdf files of the By-laws] A By-law to amend By-law No. A-0380-2006-049 imposing fees and charges for services and activities and use of property provided by the Transportation Services and Environmental Services Departments of The Regional Municipality of York To acquire certain lands for or in connection with the construction of an interchange at Doane Road (YR 45) and the proposed Highway 404 extension in the Town of East Gwillimbury To levy against the lower-tier municipalities on an interim basis the sums of monies required during the year 2010 for the purposes of The Regional Municipality of York A by-law to adopt an Emergency Management Program To dedicate certain lands for the purposes of public highways To acquire certain lands for or in connection with the widening and reconstruction of Highway 50 (YR 24) from Highway 7 (YR 7) to Rutherford Road (YR 73), City of Vaughan Carried OTHER BUSINESS 5 Fees for Trucks Bringing Fill into Municipalities Mayor Emmerson requested staff to investigate and bring forward a report in the near future to address fees for trucks bringing fill into municipalities. 6 Audit Committee Regional Chair Fisch announced the appointment of Mayor Black, Mayor Morris, Regional Councillor Taylor and Mayor Van Bynen to the Audit Committee. It was moved by Mayor Young, seconded by Regional Councillor Spatafora that the next meeting of the Audit Committee be rescheduled to Thursday, February 4, 2010 at 12:00 noon. Carried 7 York Region United Way Awards Dinner Regional Chair Fisch announced the following winners of awards for their 2009 United Way Campaigns: Municipal Challenge - Town of Aurora Towns/Cities with 300 or more staff - Town of Richmond Hill Community Fund Spirit Award - York Region Regional Chair Fisch congratulated the Towns of Aurora and Richmond Hill and Commissioner Llewellyn-Thomas, Deputy Police Chief Herridge and all Regional and Police staff for their hard work and dedication in making the Campaigns such a big success. 8 2010 Schedule of Council and Committee Meetings Regional Chair Fisch indicated that in February he would be introducing changes to the Council and Committee schedule - particularly relating to September, October and November, 2010 - in order to accommodate recent changes by the Province to Municipal Election Day. 9 January 28, 2010 Council Workshop Regional Chair Fisch reminded Council of next week's Council Workshop to consider options for the allocation of funds received from the Province under the Investing in Ontario Act. 10 Increase in Traffic-Related Pedestrian Fatalities Kathleen Llewellyn-Thomas, Commissioner of Transportation Services, provided Council with a brief overview of traffic-related pedestrian fatalities in the GTA over the last few weeks, two of which occurred in York Region. A report on this topic will be coming to the Transportation Services Committee in the next few months. 11 PRIVATE SESSION It was moved by Regional Councillor Hogg, seconded by Regional Councillor Wheeler that Council convene in Private Session for the purpose of considering the following: 1. Private Report of the Finance and Administration Committee - Options to Finance the Potential Conversion of the York Regional Police Sick Leave Plan - Labour Relations. 2. Private Report of the Community and Health Services Committee - Emergency Shelter for Homeless Women Development Opportunity - Security of Municipal Property. Carried Council met in Private Session at 10:33 a.m. and reconvened in Council at 11:17 a.m. It was moved by Regional Councillor Rosati, seconded by Mayor Young that Council rise and report from Private Session. Carried 12 Emergency Shelter For Homeless Women Development Opportunity It was moved by Mayor Van Bynen, seconded by Regional Councillor Wheeler that Council adopt the recommendations contained in the private report of the Community and Health Services Committee, dated June 10, 2009, as amended, as follows: 1. Staff be directed to pursue development of a site in the Town of Newmarket for a 40 bed shelter/transitional housing facility for homeless, single women. 2. The Community Team, which has initiated this project, be challenged to raise $1 million to offset the capital costs of the facility and to develop a strategy to provide ongoing support for the operating costs of the project. 3. The Commissioner of Community and Health Services, or designate, be authorized to make an application for any available funding from the federal and/or provincial governments to assist with capital or operating costs of this development. 4. The Commissioner of Community and Health Services, or designate, be authorized to secure the required municipal approvals to facilitate the development of the project. 5. The Commissioner of Community and Health Services, or designate, be authorized to enter into any and all funding agreements with Blue Door Shelters to manage the shelter and transitional housing programs of the facility within approved budgets, subject to the review of Legal Services. Carried The balance of the report to remain private under the provisions of the Municipal Act as it pertains to the Security of Municipal Property. 13 CONFIRMATORY BY-LAW It was moved by Regional Councillor Heath, seconded by Regional Councillor Hogg that Council enact the following by-law to confirm the proceedings of this meeting of Council. To confirm the proceedings of Council at its meeting held on January 21, 2010. Carried The Council meeting adjourned at 11:19 a.m.
