Regional Council met at 9:02 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

Opening Remarks from Regional Chairman
19 Regional Chair Emmerson made the following remarks:
“I would like to begin today’s meeting by acknowledging that York Region extends over lands originally used and occupied by Indigenous Peoples, and on behalf of York Region, I would like to thank First Nations and the Métis for sharing this land.
I would also like to acknowledge the Chippewas of Georgina Island First Nation as our closest First Nation community.”
Introduction of Alternate Member of Regional Councillor – Township of King

20 King Township - Appointment of Alternate Member of Council
It was moved by Mayor Van Bynen, seconded by Regional Councillor Rosati that Council receive the communication from Kathryn Moyle, Township Clerk, King Township dated January 30, 2018, certifying the appointment of Bill Cober as the Township of King’s alternate representative to Regional Council for the remainder of the 2014-2018 term.
Bill Cober then orally recited his signed Declaration of Office.
On behalf of Regional Council, Regional Chairman Emmerson welcomed Councillor Cober.

22 Retired Teachers of Ontario (RTO) 50th Anniversary
It was moved by Councillor Cober, seconded by Regional Councillor Hogg that Council receive the communication from Paul Devlin, 1st Vice-President, RTO District 34 – York Region dated January 9, 2018 and recognize March 22, 2018 as ‘Retired Teachers of Ontario Day’ in York Region.

23 Call to Action - Fire Medic Protection Needed for Municipal Governments
It was moved by Mayor Van Bynen, seconded by Regional Councillor Jones that Council receive the communication from Monika Turner, Director of Policy, Association of Municipalities of Ontario dated February 2, 2018 and adopt the resolution as follows:
WHEREAS Bill 160, the Strengthening Quality and Accountability for Patients Act amended the Ambulance Act to permit the Ministry of Health and Long Term Care to enable two pilot projects hosted by willing municipal governments to allow fire fighters, certified as paramedics, to treat patients while on duty with a fire department; and
WHEREAS the Government of Ontario is committed to proceeding with the pilots and enabling the fire-medic model despite the absence of objective evidence to show that it would improve patient outcomes or response times; and
WHEREAS the current interest arbitration model, particularly in the fire services sector, allows arbitrators to impose awards on unwilling employers that directly impact the employer’s ability to determine how it will deploy its workforce, as evidenced by the experience of many municipalities in regards to the 24-hour shift; and
WHEREAS in the absence of legislative protection, unwilling municipalities may be forced to enter into a pilot or adopt a fire-medic model as a result of interest arbitration; and
WHEREAS the Association of Municipalities of Ontario and its municipal members have called on the Government of Ontario to introduce legislative amendments to the Fire Protection and Prevention Act, 1997 and the Ambulance Services Collective Bargaining Act to preclude arbitrators from expanding the scope of work for fire fighters and paramedics respectively through interest arbitration awards; and
WHEREAS there is precedent for a restriction on the scope of jurisdiction of arbitrators in section 126 of the Police Services Act which precludes arbitrators from amending the core duties of police officers; and
WHEREAS the Government of Ontario has committed that no unwilling municipal government will have a fire-medic pilot or program imposed upon them.
NOW THEREFORE be it resolved that:
1. The Regional Municipality of York calls on the Government of Ontario to act immediately so that legislative amendments, that will protect unwilling municipalities from being forced by arbitrators to have a fire medic pilot or program, are placed within the upcoming Budget Bill before the Ontario Legislature rises for the provincial election.
2. A copy of this resolution be forwarded to Premier Kathleen Wynne, Office of the Premier; Hon. Dr. Eric Hoskins, Minister of Health and Long Term Care; Hon. Marie-France Lalonde, Minister of Community Safety and Correctional Services; Hon. Kevin Flynn, Minister of Labour, Hon. Bill Mauro, Minister of Municipal Affairs; York Region members of provincial parliament; and the Association of Municipalities of Ontario.

It was moved by Regional Councillor Ferri, seconded by Regional Councillor Spatafora that Council adopt the recommendations in Report No. 2 of Committee of the Whole.

26 Report No. 3 of Committee of the Whole – February 8, 2018
It was moved by Mayor Barrow, seconded by Regional Councillor Li that Council adopt the recommendations in Report No. 3 of Committee of the Whole with the following amendment as noted:
York Region 2017 Employment and Industry Report (Clause 4)
1. The York Region 2017 Employment and Industry Report (Attachment 1) be circulated by the Regional Clerk to local municipalities, local Chambers of Commerce, Board of Trade and the Workforce Planning Board, Premier of Ontario, Ontario Minister of Economic Development and Growth, Minister of Infrastructure and Minister of Transportation.
2. The future York Region Employment and Industry Reports include statistics as they relate to the agricultural industry in each municipality. Statistics can be obtained by working with the following organizations: The Ontario Ministry of Agriculture Food & Rural Affairs (Analyst Tool); York Farm Fresh Organization; York Federation of Agriculture; Golden Horseshoe Food and Farming Alliance; and any other relevant local agricultural resource.

Notice of Motion
29 Bill 139 – Local Appeals Body
It was moved by Mayor Dawe, seconded by Mayor Van Bynen that:
Whereas Section 8.1 (1) of the Planning Act states, “if a municipality meets the prescribed conditions, the Council may by by-law constitute and appoint one appeal body for certain local land use planning matters, composed of such persons as the Council considers advisable, subject to subsections (3), (4) and (5). 2006, c.23, s.7”; and
Whereas Bill 139, Building Better Communities and Conserving Watersheds Act, 2017 has received Royal Assent; and
Whereas a Local Appeals Body can be constituted as the appeal body for Committee of Adjustment decisions as provided for by Bill 51, the Planning and Conservation Land Amendment Act, 2006
Now Therefore Be It Hereby Resolved That York Regional Council consider the formation of a Local Appeals Body as per section 8.1 (1) of the Planning Act; and
That staff be directed to investigate and report back to Regional Council on the implementation of a Local Appeals Body.
Under Section 18.4 of Procedural Bylaw 2014-18, this motion will be referred to the Committee of the Whole agenda for March 22, 2018.

35 Update on Processing Restrictions at Waste Processing Facility
It was moved by Regional Councillor Ferri, seconded by Mayor Quirk that Council adopt the following recommendation in the confidential report from the Commissioner of Environmental Services dated January 18, 2018:
1. Council authorize the Commissioner of Environmental Services to amend York Region’s contract with Orgaworld Canada to reduce the minimum annual contract tonnage from 52,000 tonnes to 50,000 tonnes of source separate organic waste for the remainder of the current contract term and optional extensions.

36 ONA Collective Agreement Ratification
It was moved by Regional Councillor Rosati, seconded by Mayor Dawe that Council adopt the following recommendation in the confidential report from the Commissioner of Corporate Services dated February 15, 2018:
1. Council ratify the renewal collective agreement reached with the Ontario Nurses’ Association (ONA) for the period April 1, 2017 to March 31, 2019, reflecting the Minutes of Settlement described in this report. Included are economic adjustments of 1.6 per cent retroactive to April 1, 2017 and 1.5 percent effective April 1, 2018. All adjustment and benefit improvement costs fall within the previously approved Council mandate.
