Regional Council met at 9 a.m. in the Council Chambers, York Region Administrative Centre, 17250 Yonge Street, Newmarket, with Regional Chair Emmerson presiding.

It was moved by Mayor Dawe, seconded by Regional Councillor Li that Council confirm the Minutes of the Council meeting held on April 20, May 11 and May 18, 2017 in the form supplied to the Members.

72 Legalization and Regulation of Cannabis

 

It was moved by Regional Councillor Armstrong, seconded by Mayor Dawe that Council receive the communication from Joy Hulton, Regional Solicitor dated March 25, 2017 and that the Regional Clerk forward a copy of the memorandum to each of the local municipalities.

73 Pride Week - June 9 to 18, 2017

 

It was moved by Regional Councillor Spatafora, seconded by Mayor Pellegrini that Council receive the communication from Jacob Gal, Development & Communications, York Pride dated April 12, 2017 and recognize June 9 to 18, 2017 as Pride Week in York Region.

74 Seniors' Month - June 2017

 

It was moved by Regional Councillor Hogg, seconded by Regional Councillor Ferri that Council receive the communication from Dipika Damerla, Minister of Seniors Affairs dated April 18, 2017 and recognize June 2017 as Seniors’ Month.

75 2016 York Region Housing Supply

 

It was moved by Regional Councillor Li, seconded by Mayor Altmann that Council receive the communication from Danielle Chin, Senior Manager, Policy & Government Relations, BILD dated May 24, 2017 and refer it to Clause 5 of the Committee of the Whole Report No. 9.

76 Proposed Changes to the Land Use Planning Appeal System

 

It was moved by Regional Councillor Rosati, seconded by Regional Councillor Davison that Council receive the communication from Valerie Shuttleworth, Chief Planner dated May 25, 2017.

77 2017 Development Charge Background Study and Bylaw

 

It was moved by Regional Councillor Spatafora, seconded by Regional Councillor Rosati that Council receive the communication from Robert Webb, Berczy Glen Landowner Group Manager, Webb and Co. Limited dated May 24, 2017 on behalf of Berczy Glen Landowner Group (the 'BGLG") and refer it to Clause 6 of the Committee of the Whole Report No. 9.

78 2017 Top Ten Public Works Leader

 

Regional Chair Emmerson joined Mary-Frances Turner, President, York Region Rapid Transit Corporation in recognizing Paul May, York Region Rapid Transit Chief Engineer, for being named to the American Public Works Association 2017 Top Ten Public Works Leaders of the Year. The award honours excellence and dedication for public works professionals in the private and public sectors. Paul began his career with York Region in 1988. His career achievements include planning and implementing the first phase of Viva rapid transit and overseeing complex rapid transit projects on behalf of the Region, totalling over $3 billion in new infrastructure.

It was moved by Regional Councillor Spatafora, seconded by Mayor Hackson that Council receive the communication from Laura Bynum, Media Relations/ Communications Manager, American Public Works Association, Kansas City, MO dated May 8, 2017.

Consideration and Adoption of Reports

It was moved by Regional Councillor Taylor, seconded by Regional Councillor Spatafora that Council adopt the recommendations in Report No. 8 of Committee of the Whole.

80 Report No. 9 of Committee of the Whole – May 18, 2017

 

It was moved by Mayor Barrow, seconded by Regional Councillor Ferri that Council adopt the recommendations in Report No. 9 of Committee of the Whole with the following amendment as noted:

 

2017 Development Charge Background Study and Bylaw (Clause 6)

4.1 Council approve the 2017 Development Charge Bylaw incorporating the policies and rates set out in the 2017 Development Charge Background Study as released on May 18, 2017 (Attachment 1), as revised in this report, with an effective date of June 17, 2017.

81 Bylaws

 

It was moved by Mayor Pellegrini, seconded by Mayor Quirk that Council approve and enact the bylaw in Clause 6 of Committee of the Whole Report No. 9 (Development Charge Bylaw) and the following bylaws in the form as noted on the Revised Agenda.

 

Bylaw No. 2017-26

 

A bylaw to establish tax ratios and to specify the percentage by which tax rates are to be reduced for prescribed property subclasses for 2017

 

Bylaw No. 2017-27

 

A bylaw to set and levy the rates of taxation for Regional general purposes for the year 2017

 

Bylaw No. 2017-28

 

A bylaw to delegate authority to the Regional Treasurer to establish “clawback” percentages for the 2017 taxation year for the commercial and industrial property classes

 

Bylaw No. 2017-29

 

A bylaw to amend Bylaw No. R-629-79-109 to authorize the erection of stop signs

Other Business

 

82 Lina Bigioni – 2016 Civic Leadership Award – Police Services Board

 

Regional Chair Emmerson recognized Lina Bigioni, Chief of Staff for receiving the 2016 Civic Leadership Award presented to her by the York Regional Police Services Board.

 

83 Federal and Provincial Funding – Water and Wastewater

 

Regional Chair Emmerson advised that the federal and provincial governments have announced a total of $34.8 million in funding for York Region’s water and wastewater initiatives.

 

84 Yonge Subway Extension

 

Regional Chair Emmerson provided an update on the Yonge Subway Extension project following recent announcements from the City of Toronto.

 

85 Development Charge Bylaw Contingency Projects

 

It was moved by Mayor Bevilacqua, seconded by Regional Councillor Armstrong that Council adopt the following recommendations:

 

WHEREAS the Provincial Growth Plan requires the Region of York to grow to 1,590,000 persons and 790,000 jobs by the year 2031;

WHEREAS the draft 2016 amendments to the Provincial Growth Plan contemplates requiring the Region of York to grow to 1,790,000 persons and 900,000 jobs per hectare by the year 2041;

AND WHEREAS Regional Council is required to adopt a Development Charge Bylaw on or before June 17, 2017 in order to continue collecting Regional development charges;

AND WHEREAS the infrastructure necessary to accommodate the population and employment numbers imposed upon the Region by the Provincial Growth Plan are prohibitive as a result of Region’s current revenue collection constraints;

AND WHEREAS Regional Council is in receipt of resolutions from the Council of the City of Markham and the Council of the City of Vaughan which resolutions call for the inclusion of certain groups of additional projects in the 2017 Regional Development Charge Bylaw;

AND WHEREAS Regional Council is in receipt of a resolution from the Council of the Town of Richmond Hill which calls for the amendment of the timing and scope of certain specific projects;

AND WHEREAS  the statutory time lines which require adoption of a new Development Charge Bylaw do not provide sufficient time to revise the draft 2017 bylaw to include or amend some or all of the projects referred to in the Markham, Vaughan and Richmond Hill Council resolutions;

 

NOW THEREFORE BE IT RESOLVED THAT:

1. Regional Council direct Regional staff to bring forward a report and draft 2017 Regional Development Charge Bylaw on or before March 31, 2018.

2. Such amending bylaw have the effect of adding the Contingency “B” list of “Transportation Master Plan projects subject to a financial trigger” contained in the 2017 Regional Development Charge bylaw.

It was moved by Regional Councillor Heath, seconded by Mayor Hackson that Council enact Bylaw No. 2017-33 to confirm the proceedings of this meeting of Council held on June 29, 2017.
