IN THE MATTER OF an application by The Regional Municipality of York for approval to expropriate the lands and interests in lands described Schedule A attached, in the City of Vaughan in the Regional Municipality of York, for the purpose of facilitating the road widening and improvements of Highway 50 (Y.R. 24) from Rutherford Road (Y.R. 73) to Albion-Vaughan Road being:
1. Fee Simple: all right, title and interest for the purpose of widening a highway (“Fee Simple”).
2. Temporary Construction Easement: Temporary Limited Interests for the purpose of a free, uninterrupted and unobstructed temporary easement in gross or rights in the nature of a temporary easement in gross, on an exclusive basis as necessary, for a term of six (6) years commencing upon the date of registration of the plan of expropriation for the purposes of accessing, entering upon and occupying the lands by The Regional Municipality of York including its servants, agents, employees, contractors, sub-contractors, and workers with all necessary vehicles, machinery, equipment, material and supplies required to facilitate the widening and improving of Highway 50 (Regional Road #24) grading and other works ancillary thereto (“Temporary Construction Easement”).
3. Permanent Drainage Easement: Limited Interests in Perpetuity for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to access, enter, occupy and re-enter the lands by The Regional Municipality of York including its servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the applicable lands for the municipal purpose of constructing, installing, operating, maintaining, inspecting, altering, removing, replacing, reconstructing, enlarging and repairing drainage ditches, culverts, headwalls, retaining walls, and related appurtenances, and side-slopes and grading appurtenant to the widening and improving of Highway 50 (Regional Road #24) including, without limiting the foregoing, the removal of trees, shrubs, bushes, branches, stumps and roots and the prevention or control of growth of same, and the removal of any other material or object which may interfere with the use and enjoyment of this easement or damage the infrastructure within the easement area ("Permanent Drainage Easement").
4. Permanent Line and Pole Easement: Limited Interests in Perpetuity for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to access, enter, occupy and re-enter the easement lands at any time by The Regional Municipality of York and its authorized users, including but not limited to its servants, agents, employees, contractors, sub-contractors, workers, and by The Regional Municipality of York’s successors and assigns and their authorized users, and by entities authorized by statute to enter and occupy the easement lands for the purposes set out herein, with all necessary material, including, but not limited to, vehicles, machinery, tools, supplies and equipment at all times in, on, through, under, over, across, along and upon, the easement lands for the purposes of facilitating the widening and improving of Highway 50 (Regional Road #24) together with all works ancillary thereto including, but not limited to: (i) to erect, maintain, operate, repair, replace, relocate, upgrade, reconstruct and remove at any time and from time to time, an electrical transmission line or lines and communication line or lines consisting of poles and anchors with all necessary guys, braces, wires, cables, padmount equipment, if necessary, underground cable and associated material and equipment (all or any of which works are herein called the “Line"); (ii) to enter on and erect, maintain and use such gates in any fences which are now or may hereafter be installed on the easement lands required for access to the Line; (iii) to enter on and mark the location of the Line under the easement lands, where applicable, by suitable markers, located so as to minimize interference with any reasonable use of the easement lands; (iv) to enter on and selectively cut trees and shrubs on the easement lands and to keep same clear of all trees, shrubs and brush which may interfere with the safe operation and maintenance of the Line; (v) to conduct engineering and legal surveys in, on and over the easement lands; (vi) to clear those portions of the easement lands on which the Line is located and keep such lands clear of all buildings, structures or other obstructions of any nature whatsoever (including swimming pools and wading pools) including removal of any materials which are hazardous to the Line; and (vii) to remove, relocate and reconstruct the Line on or under the easement lands. (“Permanent Line and Pole Easement”).
5. Permanent Aerial Easement: Limited Interests in Perpetuity for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by The Regional Municipality of York including its servants, agents, employees, contractors, sub-contractors, workers and entities authorized by statute to enter and occupy lands for the purposes set out herein, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times over, through, above and along the applicable lands for the purpose of facilitating the widening and improving of Highway 50 (Regional Road #24) and associated works including, but not limited to, the accommodation, construction, installation and/or relocation of aerial electricity transmission equipment and distribution lines and any telecommunications facilities forming a part thereof, and all related appurtenances and accessories thereto together with all rights necessary for the proper and efficient operation, maintenance, inspection, repair, alteration, removal, replacement, reconstruction, extension or enlargement of said works (“Permanent Aerial Easement”).
6. Permanent Hydro Easement: Limited Interests in Perpetuity for the purpose of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by The Regional Municipality of York including its servants, agents, employees, contractors, sub-contractors, workers, and entities authorized by statute to enter and occupy lands for the purposes set out herein, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, under, over, across, upon, along and through, the applicable lands for the purpose of facilitating the widening and improving of Highway 50 (Regional Road #24) and associated works including, but not limited to, the accommodation, construction, installation and/or relocation of an electrical distribution system and communication line(s) consisting of all electrical servicing supply and support equipment and infrastructure necessary to provide electrical servicing, and all related appurtenances and accessories thereto together with all rights necessary for the proper and efficient operation, maintenance, inspection, repair, alteration, removal, replacement, reconstruction, extension or enlargement of said works (“Permanent Hydro Easement”).
NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate the lands and interests in lands described in Schedule A attached.
Any owner of land in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,
(a) in the case of a registered owner, served personally or by registered mail within thirty (30) days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty (30) days after the first publication of the notice;
(b) in the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.
