Notice of Application for Approval to Expropriate Land – Kennedy Road from Highway 407 to Highway 7
NOTICE OF APPLICATION FOR APPROVAL TO EXPROPRIATE LAND
EXPROPRIATIONS ACT
In the matter of an application by The Regional Municipality of York for approval to expropriate land in the City of Markham, being described in Schedule ‘A’, as the case may be, as follows:
1) all right, title and interest (“Fee Simple”);
2) temporary easements or rights in the nature of temporary easements described as temporary limited interests commencing on registration of the plan of expropriation for a duration of five years in, under, over, along and upon and for municipal purposes including, but not limited to, entering on the lands with all vehicles, machinery, workmen and other material for construction purposes, which may include (1) relocation of existing services and utilities, (2) work that supports the construction of municipal infrastructure within the Region’s permanent takings, (3) staging and storage of materials and equipment, (4) geotech testing, borehole testing and other investigative works, (5) removal, relocation, and/or installation of signage, (6) hard and soft landscaping, paving, grading and reshaping the lands to the limit of the reconstruction of the municipal road fronting the lands herein described, (7) the installation and removal of temporary (i) pedestrian access and walkways, (ii) parking measures including re-striping of aisles, lanes, and parking stalls, (iii) shoring and formwork, (iv) drainage and erosion/sediment control measures, (v) traffic signals, (vi) fencing, and (vii) handrails, and (8) works ancillary to any of the foregoing and necessary to the works to be performed in association with the purpose of implementing road and intersection improvements along Kennedy Road (“Temporary Easement”); and
3) permanent easements or rights in the nature of permanent easements described as limited interests in perpetuity in, under, over, along and upon and for municipal purposes including, but not limited to, entering on the lands with all vehicles, machinery, workmen and other material (i) to construct and maintain permanent municipal infrastructure which may include installation, maintenance, relocation and/or removal of traffic turning loops and associated signalization equipment and controls, retaining walls, shoring and formwork and/or drainage, erosion or sediment control measures such as watermains and storm sewers, and (ii) for construction purposes which include, but are not limited to, (1) relocation of existing services and utilities, (2) staging and storage of materials and equipment, (3) geotech testing, borehole testing, and other investigative works, (4) removal, relocation and/or installation of signage, (5) hard and soft landscaping, paving, grading and reshaping the lands to the limit of the reconstruction of municipal road fronting the lands herein (“Permanent Easement”),
for the purpose of widening and improving Kennedy Road (Y.R. 3) from Highway 407 to Highway 7 (Y.R. 7) and to provide designated lanes for the Bus Rapid Transit Project, and works ancillary thereto.
Notice is hereby given that application has been made for approval to expropriate the land described in Schedule ‘A’.
Any owner of land in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,
(a) in the case of a registered owner, served personally or by registered mail within thirty days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty days after the first publication of the notice;
(b) in the case of an owner who is not a registered owner, within thirty days after the first publication of the notice.
