WHEREAS on November 25, 2021, Regional Council passed Bylaw No. 2021-103 Procurement Bylaw (“as amended”) (the “Procurement Bylaw”);
AND WHEREAS on June 25, 2026, Regional Council authorized the Regional Treasurer to amend the Procurement Bylaw to permit compliance with applicable legislation, regulations, and binding provincial or federal directives, including the Buy Ontario Act (Public Sector Procurement), 2025;
The Council of The Regional Municipality of York enacts as follows:
1. Subsection 3.3 of the Procurement Bylaw is hereby deleted and replaced with the following:
3.3 If there is a conflict between an obligation of the Region under any applicable legislation, regulation, or binding provincial or federal directives (collectively, “legislation”), an obligation of the Region under any applicable domestic or international treaty governing procurement (“trade treaty”), and/or an obligation of the Region under this bylaw, the Region shall comply with its obligation under the legislation. The Procurement Review Committee shall review any conflicts arising under this provision and determine the applicable obligation.
2. Where this bylaw refers to a schedule, enactment, statute, regulation, or bylaw, it also includes that schedule, enactment, statute, regulation, or bylaw, as amended, supplemented, or replaced from time to time.
3. Except as expressly modified by this bylaw, all provisions of the Procurement Bylaw are, and shall continue to be, in force and effect.
4. This bylaw comes into force and effect upon passage.
