Parking and Stopping on Regional Roads (Amendment)

WHEREAS on May 18, 2023, Regional Council passed Bylaw No. 2023-34 being a bylaw to prohibit or regulate parking and stopping on Regional roads, which was amended by Bylaw No. 2024-28 and Bylaw No. 2024-39 (altogether the “Parking and Stopping on Regional Roads Bylaw”);

AND WHEREAS the Parking and Stopping on Regional Roads Bylaw refers to City of Markham Bylaw 2015-93, which has since been repealed and replaced by City of Markham Bylaw 2024-137;  

AND WHEREAS it is helpful to clarify that a reference to any bylaw of a lower-tier municipality in the Parking and Stopping on Regional Roads Bylaw includes such bylaw as amended or repealed from time to time; 

AND WHEREAS Bylaw No. 2023-31 authorizes bylaws to be submitted directly to Regional Council to update references to legislation and clarify language; 

The Council of The Regional Municipality of York enacts as follows:

1.    All references to City of Markham bylaw number “2015-93” in sections 14.3, 15.2, 16.2, and 17.1 of the Parking and Stopping on Regional Roads Bylaw are hereby deleted and replaced in each case with “2024-137”.

2.    Sections 13.1, 13.2, 13.3, 14.3, 14.4, 14.5, 15.2, 15.3, 15.4, 16.2, 16.3, 16.4, 17.1, 17.2, and 17.3 of the Parking and Stopping on Regional Roads Bylaw are hereby amended to delete each instance of the words “as amended from time to time” and replace each such instance with the following words: “as amended or replaced from time to time.” 

3.    Sections 17.4, 17.5, and 17.6 of the Parking and Stopping on Regional Roads Bylaw are hereby amended to delete each instance of “supplemented,”. 

4.    Where this bylaw refers to a schedule, enactment, statute, regulation, or bylaw, it also includes that schedule, enactment, statute, regulation, or bylaw, as amended, supplemented, or replaced from time to time. 

5.    Except as expressly modified by this bylaw, all provisions of the Parking and Stopping on Regional Roads Bylaw No. 2023-34 are, and shall continue to be, in force and effect.

6.    This bylaw comes into force and effect upon passage.
