Court appearances for Part III charges have changed
Effective January 1, 2023, The Regional Municipality of York Court Services will be prosecuting and responding to appeals relating to Part III Provincial Offences Act (POA) charges. These charges, previously prosecuted by the Ministry of the Attorney General have been transferred to York Region courts. Part III POA charges include driving while under suspension, drive with no insurance and stunt driving.
After January 1, 2023, if you wish to speak to a prosecutor to discuss your Part III POA charge, please call (905) 898-8123. To obtain disclosure, please email your request to @email
If you believe you are not guilty of the charge noted on your ticket, there are three ways to request a trial. First, sign your ticket under Option 3, then:
- Scan and email to @email OR @email
- Mail it to the address on the ticket
- Deliver it in person to the address on the ticket either by visiting in person or by booking an appointment; booking an appointment is encouraged to avoid long wait times
York Region Provincial Offences courts are open to the public for remote and in-person hearings.

Certified evidence for a prosecution case
The prosecution may present its case through certified evidence without having to call the officer as a witness. Certified evidence consists of the statements in the Certificate of Offence, certified photographs and certified ministry documents.
The admissibility for these offences is set out in the Highway Traffic Act and regulations. Section 48.1 of the Provincial Offences Act also allows for admissibility of Certified evidence for any Part I proceeding where a set fine exists for the offence.
Disclosure request
You have a right to obtain officer’s notes and any other relevant evidence involving the charge against you, also known as disclosure, to help you prepare for your trial. If you have received an Offence Notice (Form 3) and you have requested the trial option, you can request disclosure by completing and submitting the Disclosure Request Form online by using the button below.

Once disclosure is available, the Prosecutors Office will forward the disclosure to the email address you provided in the Disclosure Request Form. All information required for completing the Disclosure Request Form is available on the Offence Notice (Form 3) that you received.
For Part III Highway Traffic Act and Compulsory Automobile Insurance Act charges where you received a Summons (Form 104 or Form 106), you can request disclosure from the Provincial Prosecutor by emailing @email

If you have received a court-ordered fine
If you receive a fine ordered by the Court, you are responsible to pay the fine in full, including the added Victim Fine Surcharge and court costs, within the time period indicated by the Justice of the Peace.
Pleading guilty after the trial is set
You can give up your right to a trial and plead guilty at any time before the trial date. You can pay your ticket online or by calling our court office up to three days before the trial date, in person at any Provincial Offences Court in Ontario or you can schedule an appointment in advance to speak with the Justice of the Peace to plead guilty and provide submissions about the penalty.

- Download the app through the Zoom website for a desktop application (Zoom Client for Meetings) or through the mobile device’s app store (Apple’s App Store or Android’s Google Play Store)
- When ready to connect, use the ‘Join a Meeting’ function on the app which will bring the participant through the sign in process where they can enter the meeting ID and passcode

Accessibility Request
Parties or participants that are unable to appear by remote means (if they do not have access to the required device or technology or if they require a disability-related accommodation) may make a request in advance through the Courts Accessibility Coordinator. Each matter will be handled on a case by case basis. Approvals will need to be provided by the Regional Senior Justice of the Peace.

What happens if I cannot attend my remote trial or I miss it?
You or your agent can call the court office shown on the trial notice well in advance of the trial date to ask about a Notice of Motion requesting a change of trial date. The court may grant or refuse your adjournment request.
If you cannot attend court on your trial date and you cannot bring a motion before the trial date as a result of a last-minute emergency, you may ask someone to attend the trial date in order to request a new trial date. The court may or may not grant a change of trial date.
If you miss your trial date, the Justice of the Peace may convict you in your absence. You can apply to have your conviction struck out and a new trial scheduled.
If you were initially given an Offence Notice (ticket) you can obtain a “Record of Reopening Application” (hyperlink to form) within 15 days of becoming aware of the conviction. There are three ways to submit this form:
- Email to @email or @email
- Mail to the address on the ticket.
- Deliver it in person or make an appointment to deliver in person to the address on the ticket: appointments are encouraged to avoid long wait times
The application will be reviewed by a Justice of the Peace who will consider the reasons for your failure to appear at trial. The re-opening may or may not be granted.
- If you were served with a Summons (as opposed to an Offence Notice), the trial may take place in your absence or a new trial date may be selected without further notice to you after which you may be convicted in your absence. You may appeal the conviction.
