Development Planning Review
York Region reviews and approves development applications submitted under the Planning Act and is responsible for ensuring Provincial planning regulations and Regional interests are protected through the implementation of the Regional Official Plan.
All development applications, with the exception of Regional Official Plan Amendment applications, are received, processed and circulated by the local municipality. Contact the appropriate local municipality regarding their application process:
Town of Aurora, Town of East Gwillimbury, Town of Georgina, Township of King, Town of Newmarket, City of Markham, City of Richmond Hill, City of Vaughan and Town of Whitchurch-Stouffville.
York Region assumes different roles for each application type:
- Commenting agency on zoning bylaw amendments, draft plans of subdivision and condominium, site plans, consents and minor variance applications, applications to amend the Minister’s Zoning Order and Parkway Belt West Plan
- Approval authority for all local Official Plans and Official Plan Amendment applications
- Engineering approvals for any work within the Region's right-of-way or impacting Regional infrastructure related to development (e.g. road, water, wastewater infrastructure, access, utilities)

Regional Development Charges
All new developments in York Region are required to pay Development Charges. For Zoning by-law amendment and Site Plan applications, the applicant is required to execute an Agreement with York Region stating the date at which Development Charge rates are frozen for the development proposal.

Delivery of Security Deposit
Security Deposit may be in the form of a letter of credit or a certified cheque.

Regional Official Plan Applications
The Regional Official Plan is a statutory document which sets out land use policy to guide future growth and development. If an owner proposes to develop a property differently than what is prescribed by the approved Regional Official Plan, they must apply to York Region for a Regional Official Plan Amendment. York Regional Council is the approval authority for Regional Official Plan Amendments.
Regional Official Plan Amendment Process
When you request an amendment to the York Region Official Plan:
- Pre-Consultation Meeting: Pre-consultation meeting will be held with the applicant, consultants and planning staff to discuss details or concepts of the application. Staff will provide general feedback on Regional policy and establish requirements for submission of a complete application.
- Submit to the Region: York Region staff receives the application with a completed Regional Official Plan Amendment Application Form, required background information, application fees, draft Official Plan Amendment document and all requested information and material as prescribed in the Planning Act (section 2 of Ontario Regulation 543/06) and York Region submission checklist.
- Determine Complete Application: Within 30 days of application submission, staff will determine application completeness. York Region will consider the application complete if it meets the complete application submission requirements established at the pre-consultation meeting. Incomplete applications will be returned to applicant, with a letter describing the deficiencies that need to be met in order for the application to be considered complete.
- Circulation of Application: Upon receiving a complete application, staff will:
- Circulate the application and all background studies and supporting material to all prescribed persons/bodies listed in the Planning Act, other external agencies and internal departments.
Note: A peer review may be required on technical background studies such as agriculture, hydrogeology, environmental impact, retail impact, noise and vibration and growth and settlement. The peer review is done at the owner’s expense. - Notify the public by way of a newspaper ad, confirming receipt of a complete application and the supporting documentation is available for their viewing through Regional Planning staff.
- Circulate the application and all background studies and supporting material to all prescribed persons/bodies listed in the Planning Act, other external agencies and internal departments.
- Public Meeting Notice: Regional Planning staff will prepare and issue a formal notice of Public Meeting in accordance with requirements of the Planning Act (section 3 of Ontario Regulation 543/06). This notice may be coordinated with the notice of an open house.
- Public Meeting: The public meeting is held at a regular meeting of the Planning and Economic Development Committee at the Committee of the Whole, held monthly on Thursday, starting at 9:00 am. Planning staff prepares and presents an information report describing the application and identifying any issues that require additional analysis.
- Comments provided to Applicant: Staff consolidate comments received from circulation, public meeting and external agencies and forwards the response to applicants for revisions and resubmission. Resubmission package is circulated to internal/external agencies affected for review and comment.
- Report to Committee of the Whole: A final report and recommendation is prepared and presented to Planning and Economic Development Committee at the Committee of the Whole for their input.
- Report to Council: The report recommendation is forwarded to Regional Council, generally held once monthly. Council may recommend adoption of the amendment, or refusal of the application.
- Notice of Decision/Appeal Period: Notice of the decision is issued by planning staff following the decision by Regional Council (as prescribed in the Planning Act section 8 of Ontario Regulation 543/06). There is a 20 day appeal period following the notice. If there are no appeals the amendment comes into force and effect. If an appeal is received, the amendment, record and appeal are forwarded to the Local Planning Approval Tribunal (LPAT).

Local Official Plan Applications
An Official Plan is a statutory document which sets out land use policy to guide future growth and development. If an Owner proposes to develop a property differently than what is prescribed by the Local Official Plan, they must apply for an Official Plan Amendment. York Region is the approval authority for all Official Plan Amendment applications classified as follows:
- Major Area Official Plan Amendment (Secondary Plan): An application that establishes policies to guide development or redevelopment of a specific geographic area (e.g. Secondary Plan). York Regional Council is the approval authority for major official plan amendments.
- Routine Official Plan Amendment: An application which proposes changes or re-designation of the land use designation. York Region’s Director of Community Planning and Development Services is the approval authority for routine applications.
- Official Plan Exemption: The Region has the authority to exempt an Official Plan Amendment from Regional approval if it is determined to be of local significance and there is no Regional interest. The Regional Official Plan sets out criteria to determine if an amendment is eligible for exemption. If the application qualifies for exemption the local municipality will issue a decision for the Official Plan Amendment.

Submission Requirements
Plan of Subdivision and Condominium Applications
York Region is a commenting agency on applications for Plans of Subdivision and Condominium. Plan of Subdivision applications are typically needed when three or more lots or blocks are proposed to be created/subdivided that will be sold individually, or new roads are being created, existing roads are being extended, and/ or new services are being installed. York Region reviews, comments, and provides conditions of approval protecting Regional interests. York Region also provides clearance of approved conditions related to the Region, as part of the final approval process for these applications.

Submission Requirements
Zoning Bylaw Amendment, Severance and Minor Variance Applications
York Region is a commenting agency on all Zoning Bylaw Amendment, Severance and Minor Variance applications. Regional staff reviews these applications to ensure Regional interests are protected. The Region will provide comments on an application where properties are adjacent to Regional roads or infrastructure, or may have Regional interests.
